1. Description of Service

These Terms of Service govern your use of Cachet (the “Service”), operated by EXP Digital LLC (operating as Cachet) (“Cachet,” “we,” “us,” or “our”) and accessible at cachetclub.io and associated subdomains.

Cachet is a personal branding and content platform where experts, creators, and professionals publish content — including guides, articles, newsletters, recipes, and videos — build their audience, and offer paid memberships. The Service includes all features, functionalities, visual and written media, platform interfaces, and any associated software or content made available through cachetclub.io.

2. Acceptance and Changes to Terms

By accessing or using the Service, you agree to be bound by these Terms. Cachet reserves the right, at its sole discretion, to modify, add, or remove any terms or conditions at any time without prior notice. Changes take effect immediately upon posting to cachetclub.io. Your continued use of the Service following any changes constitutes your acceptance of those changes.

3. Access and Use

To access the Service, you must be at least 13 years of age. If you are registering an account or uploading any content to the platform, you must be at least 18 years of age, or have obtained verifiable parental consent. Access to the Service may not be lawful in certain jurisdictions; it is your responsibility to ensure compliance with local laws.

4. Your Conduct

The Service may only be used for lawful purposes. You agree not to:

• Violate any applicable local, state, national, or international law or regulation
• Attempt to probe, scan, or test the vulnerability of our systems or networks
• Interfere with or disrupt the integrity or performance of the Service
• Scrape, harvest, or otherwise collect data from the platform without authorization
• Use automated tools, bots, or scripts to access or interact with the Service
• Bully, harass, or intimidate other users
• Post unsolicited promotional content or spam
• Impersonate any person or entity

We expect all users to maintain a respectful and professional environment consistent with the nature of the platform.

5. User Information

You are solely responsible for the accuracy and completeness of the information you provide when registering or using the Service. You must provide a valid email address and keep all account information current and accurate. Cachet is not liable for any issues arising from inaccurate or outdated information.

6. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at hello@cachetclub.io if you suspect any unauthorized access to or use of your account. Cachet is not liable for any loss or damage arising from your failure to secure your credentials.

7. Payments & Billing

By purchasing a plan or membership on Cachet, you authorize us to charge your designated payment method for the applicable fees. Subscriptions are recurring and will continue automatically unless cancelled. You must cancel your subscription before the start of the next billing cycle to avoid being charged for the following period.

Payment processing is handled by Stripe, Inc., our third-party payment processor. Your payment information is transmitted directly to Stripe and is not stored by Cachet. By completing a purchase, you also agree to Stripe’s terms and privacy policy. Receipts are sent to the email address associated with your account.

8. User Content

You retain ownership of content you publish on Cachet. By publishing content, you grant Cachet a non-exclusive, worldwide, royalty-free license to display and deliver that content to your audience through the Service. You represent that you have all necessary rights to the content you publish and that it does not infringe any third-party rights.

Any unsolicited creative submissions, feedback, or suggestions you send to Cachet become the property of Cachet and may be used without restriction or compensation.

9. Intellectual Property

The Cachet name, logo, trademarks, and all platform-owned content, design elements, and software are the exclusive property of EXP Digital LLC. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Cachet-owned intellectual property without express written permission.

10. Social Networking

You may connect or link your social media accounts to your Cachet profile at your own discretion and responsibility. Cachet is not responsible for the content, policies, or practices of any third-party social platform.

11. Copyright Infringement (DMCA)

Cachet respects the intellectual property rights of others. If you believe that content on the platform infringes your copyright, please send a notice to hello@cachetclub.io with the following information:

• Your physical or electronic signature
• A description of the copyrighted work you claim has been infringed
• The specific URL or location of the infringing content on cachetclub.io
• Your name, address, telephone number, and email address
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or applicable law
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

12. Limitation of Liability

Your use of the Service is at your sole risk. To the fullest extent permitted by applicable law, you release Cachet, EXP Digital LLC, and their respective officers, directors, employees, affiliates, agents, and licensors from any and all claims, demands, damages, losses, costs, and expenses arising out of or related to your use of the Service.

In no event shall Cachet’s aggregate liability to you exceed the greater of (a) the amounts you have paid to Cachet in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).

13. Governing Law & Choice of Venue

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Pennsylvania, and you hereby irrevocably consent to the personal jurisdiction and venue therein.

Waiver of Jury Trial: To the extent permitted by law, both parties waive the right to a jury trial in any dispute arising from or related to these Terms or the Service.

14. Dispute Resolution

Before initiating formal legal proceedings, you agree to contact Cachet at hello@cachetclub.io and attempt to resolve any dispute informally. If a resolution cannot be reached within 30 days, either party may pursue their remedies in accordance with the governing law provisions above.

15. Warranty Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Cachet does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for any loss of data, revenue, or profits arising from your use of or inability to use the Service.

16. Termination

Cachet reserves the right to suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, third parties, or the platform.
